The vast majority of business civil cases settle outside of court. It is widely reported that over 90% of civil cases, including those involving businesses, are resolved through settlement through negotiation. Some sources even suggest figures closer to 95-96%. 

Settlements allow businesses to keep sensitive information private, avoiding public disclosure. 

Settlement negotiations allow parties to have more control over the outcome than a judge or jury. 

 Trials involve inherent risks and uncertainties, as the outcome is ultimately decided by a judge or jury.
